1. Acceptance of terms
By downloading, accessing, or using any Forfeit Limited application (the "Apps"), you agree to these Terms of Service ("Terms"), as updated from time to time. If you do not agree, do not use the Apps.
1.1 Use by minors
The Apps are not directed at young children. If you are below the age of legal majority in your jurisdiction, you may use the Apps only with the permission and supervision of a parent or legal guardian.
If you are a parent or guardian, you are responsible for the minor's use of the Apps and for any purchases made from the device or account you control. In-app purchases (including pledge top-ups) must only be made by someone authorised to incur charges on the payment method used (typically the Apple ID account holder).
2. Nature of the Apps
The Apps provide tools for voluntary, self-imposed accountability—for example alarms, optional pledge or forfeit-style mechanics, reminders, and related habit support. Features vary by App.
The Apps:
• do not guarantee any result or outcome;
• do not provide financial, medical, legal, or other professional advice (including advice about sleep disorders or health conditions); and
• are used entirely at your own discretion and risk.
3. Changes to the Apps and features
To the maximum extent permitted by law, Forfeit Limited may modify, suspend, or discontinue any App or feature; change rules, mechanics, thresholds, or logic; change pricing or availability; and fix errors or unintended behaviour. We are not obliged to keep any specific feature or behaviour.
Nothing in these Terms affects statutory rights that cannot lawfully be limited (including applicable consumer rights in your country).
4. Digital items, licences, and forfeits
4.1 Nature of in-app purchases
Optional in-app purchases (for example top-ups, pledges, or similar labels used in an App) are non-transferable digital entitlements to use functionality within the Apps. They are sold subject to Apple's applicable terms and payment processing.
They:
• have no cash value outside the Apps;
• are not deposits, savings, escrow, banking services, investments, or regulated financial products; and
• are not gambling, wagering, or betting on random outcomes.
Core functionality may remain available without a purchase, depending on the App.
4.2 Forfeit and invalidation logic
If you enable forfeit-style features, you acknowledge that breaking self-defined conditions (for example snoozing beyond allowed limits or failing a verification step) may reduce or end the associated in-app entitlement as implemented in the App. Logic and thresholds may change with updates.
No refund or compensation is owed except where required by applicable law or provided under Apple's policies.
4.3 No reliance
You agree you are not relying on the Apps operating in any particular way, or on continuity of any past version, description, marketing material, or behaviour.
5. Refunds
Purchases are processed by Apple. Refund eligibility is determined under Apple's rules and applicable law. Forfeit Limited does not control Apple's refund decisions.
6. User responsibility
You are responsible for understanding how the Apps work at the time you use them, for the consequences of your choices (including enabling pledge or forfeit features), and for safe use (for example alarms and wake-up behaviour in real-world conditions).
7. Limitation of liability
To the maximum extent permitted by law, Forfeit Limited is not liable for financial loss related to in-app forfeits or entitlement changes, missed alarms or notifications, device or OS failures, or changes to the Apps—nor for indirect or consequential losses, except where the law does not allow that exclusion or limit.
8. Suspension and termination
We may suspend, restrict, or terminate access to any App or feature where we reasonably consider it necessary (for example legal compliance, security, abuse, or risk), in addition to any rights available at law.
9. Changes to these Terms
We may update these Terms. We will update the "Last updated" date when we do. Where applicable law requires notice or consent for material changes, we will comply. Otherwise, your continued use of the Apps after the updated Terms are posted constitutes acceptance to the extent permitted by law.
10. Governing law and courts
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Subject to mandatory consumer protections that require a different court or law for certain users, the courts of England and Wales have non-exclusive jurisdiction (adjust with your lawyer if you need exclusive jurisdiction).
